EPA contract or Regular Purchase Agreement

Posted by Lughead on June 29, 2003 at 11:10 AM

hello

we found a house while driving around FSBO

when we knocked - they are in CH 13 - want to convert to a CH 7 and sell the home

if they are in BK but there was a NOD filed in the past and payments are current in the BK - should we do an EPA agreement as our contract or a regular Purchase Offer??

if an EPA - do we need to wait until the 5 days are up to put an Earnest Money deposit into escrow? - I would think not since we are not giving them money, but to the Title Co.

thanks you for the inputs
Lughead
