Travis,

#1. Yes, it sets up the issue of taking unconscionable advantage of the defaulting owner. The professional appraiser would have no place to hide, no excuse for not giving the owner in trouble at least half of the net equity in the property to avoid the charge of dealing unfairly with the owner.

#2. You cannot gain access unless you are a licensed member of the local realty board.
