No, this is America. You can't go to jail for talking with a property owner.In Reply to: Is this legal? posted by Michael Regan on May 08, 2003 at 0:26 AM : I recently had a person in foreclosure ready to sign a equity purchase agreement. We were negotiating the amount of equity and that appeared to be the only obstacle to signing. So I left to get more comps and see if I could offer more money. A couple of hours later I called and the owner said he forgot to mention that two days before he had signed with a re agent. He gave me the agents name and number. I called the agent who didn't want to talk or let me make an offer. Also he didn't list the property in the MLS, (which I have access to). Do real estate agents have to put the property in the MLS or do they have a choice? Is there anything further I can do? Should I drop this one and move on? =========== Michael, You dont have any contractual obligation with the agent, the owner does. So, as long as you're not an agent yourself, you can freely approach the owner as you see fit. An agent isnt necessarily a member of the MLS (Multiple Listing Service). However, if he is then he is obliged by the rules of MLS to enter the property into the MLS within 12 hours of obtaining the listing. Since you have been rebuffed by the agent I would work directly with the owner. Hope this helps.
