Is this legal?

I recently had a person in foreclosure ready to sign a equity purchase agreement. We were negotiating the amount of equity and that appeared to be the only obstacle to signing. So I left to get more comps and see if I could offer more money. A couple of hours later I called and the owner said he forgot to mention that two days before he had signed with a re agent. He gave me the agents name and number. I called the agent who didn't want to talk or let me make an offer. Also he didn't list the property in the MLS, (which I have access to). Do real estate agents have to put the property in the MLS or do they have a choice? Is there anything further I can do? Should I drop this one and move on?
