No trustee's deed-upon-sale was provided to BFP buyer. Have you read the disclaimer language on a Notice of Trustee's sale? Do you really think that you could put on a trial for specific performance and make it fly, especially given the time/risk-ratio/economics of such a case? Have you successfully tried such a case before with these same facts? It's nice to hear challenges however I think that too much bravado in a case like this would be misleading the client. I'm all for being proved wrong, of course.
