True Story.

: We acquired a property in CA at trustee sale on the 17th. Inspection of the property showed the electricity was off and the yard was overgrown and unkempt. All of the blinds on the inside were closed tightly (so couldn't see inside at all). Neighbors said the occupants moved out a week and a half ago. Should I post a 3 day notice and then enter after 3 days, or just get a locksmith out there, enter and change the locks? What if in either scenario, upon entering we find that it looks like someone is still living there (or coming back)? Should we just back up really slowly ;) and pretend that never happened and go ahead with an eviction?

We bought a property from Trustee Sale and the former owner's car was gone, power off and all the neighbors said he split. A window was open and I started to enter the property when my partner tapped me on the shoulder and said let's come back another day. Next, we paid someone to stake out the place for 3 days to verify no one was entering or leaving. After having done all this I was quite confident that the property was vacant and we should take possession. After a heated argument with my partner, I finally acquiesced to his demand that we "waste 30 days and $500 bucks" on an eviction. When the Sheriff's showed up a month later, to my surprise, they had to take the former owner out at gun point. He was literally insane. He had a gun collection and a knife collection. The Sheriff's took him in on a 5150 and confiscated his weapons. Long story short this could have ended up quite badly for me. So my advice is that if you cannot see inside and cannot verify 100% that the place is vacant do the eviction
