I hope Rick or Ward chimes in. I think the phrase "trust deed state". is the problem. There is CA law addressing both trust deeds and mortgages. Mortgages are less common but they do exist in CA.

I'd be interested to hear there is actual law that makes it so that lenders must use trust deeds to secure promissory notes.


: Hello ward or rick,I have this question thats being buging my mind for a minute. When did california choose to be a deed of trust state did the banks have any doing in this?. i know florida and others are judicial states which means it takes longer to foreclosure on properties and if you know how to play the game well sometimes you can delay the process so much that the lender will give up on foreclosing on you. i would like to know the year, the congress member that pass the bill and who was behind this? any help!.
