Annulling the trustee sale?

Posted by Hamster on September 05, 2008 at 4:25 PM

This is not 100% on topic in this forum, but maybe someone can help me here.

Is it possible for the lender to "annul" (postpone retroactively) a trustee sale in which there were no bidders and the house went back to the lender? Also, have you ever heard about this happening?

Here's why I'm asking.

I had an offer on a short sale. A couple of weeks ago the bank rejected my offer, selling agent withdrew the listing, and the house went to the auction. The house was offered at the courthouse steps and went "back to beneficiary". I know it, I was there.

Yesterday the MLS listing suddenly popped back up with a comment "back on the market". Same pictures, same price, same listing agent, etc. Our agent inquired, he was told that the sale was postponed. (??)

This does not make much sense to me. Either I don't understand something about the process, or something fishy is going on.
