: If you buy a property with delinquent HOA fees but thay are not recorded as a lien do thay get wiped at TS sale? Or what if you buy from the owner do you have to pay the delinquent HOA fees?

Bryan, HOA liens that aren’t recorded like any other non-recorded liens, have no priority at all. They don’t get wiped at the trustee’s sale since they never were against the title. So they remain what they are, personal liens against the ex-owner of the condo.

If you buy from the owner you’d be smart enough to know that there were unpaid dues and either deduct them from the price of the unit or from the cash being paid the seller.
