I fully agree with you. If any listing is taken and the agent fails to determine if the property is in default and they do not comply with the statue then the listing agent, selling agent and buyer (if buyer is not going to live in home) should be subject to the penalties perscribed in the statue. They might not like it, especially a first time investor just shopping through the classified section of the paper looking for his first rental. I would hope that in the licensing preparation for agents and brokers these statues are covered, if not, they should. Thank you.
