Re: Check with the DREIn Reply to: Check with the DRE posted by Ward-CA- on April 01, 2004 at 2:09 PM : : Hello : : We have a local realtor who went to a seller in foreclosure and got the listing. The price on MLS was about 20% LESS than what the place would have sold for at the auction (at least what I would have bid - and conservatively too). : : The house was sold immediately to a corporation of which this listing realtor is an officer! Thus she in a way sold it to herself. : : I asked the seller if he had ever gotten a 5 day cancellation notice and he said NO. : : Unfortunately the seller is a bit of a doofis and is too timid to do anything. : : What can I do as this violation to the civil code puts us at a disadvantage - since most average folks seem to trust realtors more than us investors. Is this a matter I can report to the DRE directly? If so - is there a format that you have found better to use IE - certain department etc.??? : : Thank you : =============== : JK, : All you have to do is go to your local DRE office and submit a written complaint. By law, they will have to follow up on your concerns and resolve the matter. I'm not clear why you want to do anything about this deal. If the Seller is not concerned why would you want to put forth the effort to "right this wrong"? From the sounds of this scenario it is defintetly possible that this realtor has committed an ethics violation. However, remember the saying about throwing rocks in a glass house. The way AB1695 is written, anyone dealing with preforeclosures is susceptable to litigation after a sale, no matter how ethically the deal is presented. The end result of your "snitching" may come back and bite you in the rear.
