There's no set time period I'm aware of...In Reply to: How long to file Trust Deed for Private Mortgage? posted by Jk (the other Jk) on March 26, 2004 at 6:08 PM
: A hypothetical friend of mine (we'll call him John Lender) made a loan to another hypothetical friend (Suzy Borrower)ten years ago with a Trust Deed against Suzy Borrower's house. John Lender never recorded the trust deed. Can John Lender still record the trust deed today if the loan is not payed off? JK, If Suzy still owns the house now, I see no rationale that would prevent John from recording his trust deed against her property today. John’s original, expected priority might be different than originally planned, if other voluntary or involuntary liens were recorded against Suzy’s property during the ensuing 10 years, and are still in place. Has Suzy made the required payments during these 10 years?
