Suing the goverment vs a trustee...

: Ward, if this was the case that occurred at a Trustee Sale, wouldn't the Trustee be liable for negligence since they failed to notify all parties involved about the sale properly?

: If I bought a property with an IRS lien at the trustee sale and hoped that the IRS doesn't redeem withing 120 days, I could be owing much more than I expected to keep the property. What would happen in this circumstance?

Steve,

Yes, in the example above the foreclosing trustee would be liable, and you’d put the monkey on their back to get the IRS lien negotiated off the title.

But that’s a lot different than suing a governmental entity like Kern County.
