Re: Legal Description VestingIn Reply to: Legal Description Vesting posted by Lisa Khalaf on March 18, 2004 at 6:05 PM : If the latest grant deed has a generic legal description for the property (i.e. does not use any specific numbers to identify the property), does the next grant deed to be filed with the Recorder need to immitate the legal description exactly? The Deed of Trust shows the more descriptive description with lot, tract, page numbers. Can I use the more specific wording in the next grant deed to be filed? If the deed to you states the book and page of the previous deed, then your subsequent deed to a buyer could reference the book and page of the previous two deeds. The chain is clear, and a title researcher can still find the legal description. Lawyers and title companies prefer to repeat the legal description on every deed; but I suspect this is a modern practice. I've seen lots of old deeds from the 1950's 1960s which just referenced the priors.
