Applies only if owner-occupant is in foreclosure...

: Am I correct in understanding that AB 1695 only applies to a property in foreclosure? What if a property was in foreclosure, but the bank cancelled the action, then you signed up a contract in the interim, and later the foreclosure action was started up again? Would AB1695 apply to this scenario?

JK,

You've got it, Civil Code §1695 only applies if the homeowner is in foreclosure and the buyer doesn't intend to occupy the property.

If you happen to buy the property after the cancellation of one foreclosure action, but before another one started then you're not required to do your deal all over again under the auspices of $1695.
