The real purpose of the post sale recording rule is to delineate the intervention rights of the bankruptcy court. A post sale bankruptcy filing made by the ex-owner won’t have any effect on the winning bidder’s right to the title of the property as long as the recording of the trustee’s deed is done with 15 business days following the foreclosure auction.
