OK to use tenants in common...In Reply to: second marriage posted by Jane on March 02, 2004 at 11:34 AM : hi! like your site. I am in a second marriage of three years. My husband didn't have assets beside what I have given him under Community Property when we bought current house. Which is now alot. I have payed all down payments. We (or I) my good credit is being used to qualify for uew morgauge) are in escrow to buy a new property. Eleven acres, avocado groves, and a house to be built. I own a triplex (sol and seperate property prior marriage)and am tired of being a landlord. I would like to sell triplex and pay of the morgauge on the new property. I don't want to gift second husdand any more than necessary. I have two sons from pryor marriage. I bought the tryplex with life insurance money after thier dads death. Would Tenants in Common and different percentages work in California. I did have a prenup about the triplex before marraige. Husband says whetever I want is OK with him, but I want to make sure I and my chrildren are not taken advantage of. I would also like to attend your trust work shop when necessary. Living in Temecula. ================= Jane, Yes, tenants in common with different percentages for you and your husband will work in CA.
