1988 recording of 1st There are a number of ways to speculate about this. But it certainly smells like the mortgagor was trying to refinance in 1998 by whomever would give him the terms to do so. I think the PMM trust deed was a false close. Just b/c something was recorded doesn't mean it's right or that funds were dispersed. That 1st from 1988, probably was not satisfied, until a bank stepped in with "outside money." If the bank's title company had any sense they would have found that recording on 6/8/1998, and gotten some kind of proof from the mortgagee, that only the original 1st was still in effect. Otherwise THEY wouldn't have allowed a closing. I'm more inclined to think that a private party would make a mistake of some kind in the courthouse, than a lender who sends stuff there every day.
