Dealing without the burden of CC §1695...In Reply to: Fine Line of EPA... posted by JK on February 03, 2004 at 10:22 PM : Hello : If the current owner is in the process of moving out of the house going to sale, do we need to use the EPA? : Would it be safe to ask them to sign stating that they have a new residence since they are moving somewhere...??? : We could sure use the extra days to get this together but dont want to get in trouble. : ====================== JK, Smart thinking. Be safe and have the property owner acknowledge in writing that they no longer use the property as their personal residence. Once you have the owner's Acknowledgment of Non-Residency then just proceed without the need to deal with the EPA or any other requirement under CC §1695. Hope this helps.
