The foreclosed owners filed bankruptcy before the auction date, and left the premises early as well. They left their couch in the living room. I would like to know if with the help of the foreclosed owner could I gain access to retreave the couch as a way to get time for my appraiser to enter the property???? Isn't the foreclose owner the legal owner until a trustee's deed is signed? Please help!! In my state (and I have no reason to expect that North Carolina is any different) a bankruptcy filed before the auction would make the auction invalid. I'd say you don't own the house, and don't need the liability that might come with trying to gain access to it. Save the money you were planning to pay the appraisor, and use it to look for another deal, or to keep track of this one until it IS a deal. If you can contact the foreclosed owners, and they still have a key that works, and are willing to let you into the house, I guess you could probably get in, but I don't think you have any reason to get inside now. If you know how to contact the owners, your time would probably be better spent finding out what they intend to do now. Maybe you can buy the property from them, with the permission of the bankruptcy court.
