Hello Ward:

I purchased a property at a sale through a foreclosure on a 2nd TD. The first TD, WAMU gave me a payoff amount $60,000 above the original DOT. Turns out there was a "modificaltion" of the senior DOT. This modification was recorded "junior" to my 2nd TD. The Modification changed the Trustor, the loan amount, and the terms. I contacted the Beneficiary of the 2nd for more info. and he said the prior owner tried to get him to subordinate his 2nd to a new 1st but he refused. So they just modified the DOT.

Isn't this Modification a junior lien that should be wiped out by the sale? and how do I do that?
