Sam,

Here's your first lesson:

1. You don't indicate the state where the property is located. Since the foreclosure laws and procedures vary from state to state it's not possible to give you an accurate answer without knowing your locale.

2. Also let us know if the property owner is living in the property being foreclosed upon.

3. Finally, I don't understand why the seller is giving you both a deed and a promissory note.

4. Since you mentioned that you opened escrow, are you also getting title insurance?
