The times I’ve foreclosed were because the senior lien was in default, so the situation was a little different.

The letter of intent sounds like a good idea, kind of like a 3 day notice to a tenant to pay or quit. However, I don’t see the down side in simply recording a NOD…that is the legal process, and they are late. So what if they didn’t “know” you were going to foreclose, it’s plastered all over the deed of trust that you’re going to foreclose if they don’t pay.

I know the practical world is different than the theoretical world, and you have a lot of experience, so I’m sure there’s merit to the notice…I just can’t quite see it.

Have you recorded a NOD without an intent letter and had a problem?
