Priority of Fed & State Tax Liens...

In Reply to: Fed & State Tax Liens: How do they affect Calif.Trustee Sale posted by Vickster on January 08, 2004 at 12:09 AM

: Do both the state and federal liens survive the trustees sale, so that the purchaser is obligated to pay them back?
: Can you negotiate the amounts owed down?
: How can I find out more?

: thanks

Vickster,

The trustee's sale wipes off the title of real property all those liens, including both state and federal liens, that are recorded subsequent to the foreclosing lien.

So, if federal or state income tax or general liens, were recorded later than the foreclosing lien they won't survive the trustee's sale.

Hope this helps.
