Greg and Ward,

Thanks for sharing these valuable information. Saved me a trip
to busy downtown.

Just to add to this knowlegebase, I downloaded the forms mentioned
above from http://www.casb.uscourts.gov/ Since Greg shared which
forms to get, it was a piece of cake. To figure out the format
that the Court wants you to use on the diskette can be found on
CSD1010: Special Requirements for Mailing Addresses.

Keep building the knowledgebase and let's continue to be successful!

Happy New Year, and I OWE you lunch, Ward. Next time!

Happy investing!
Will

: : Ward,
: : On May 12th you answered my question with a list of questions I should ask the clerk at the closest federal courthouse.
: : Taking this as an assignment, below are your questions and the
: : answers I obtained at 325 West F. Street, San Diego CA.

: : Would appreciate if you review them and
: : see if they all look correct. The one I'm a little concerned about is the minimum documentation to get started

: : Ask the clerk what parts of the petition you need to initially fill out and file as the "emergency petition" in Chapter 13.
: : THEY GAVE US:
: : 1. FORM B1 ,"Voluntary Petition", 2pgs.
: : 2. CSD1008, VERIFICATION OF CREDITOR MATRIX.
: : 3. THE FLOOPY DISK WITH THE SINGLE FILE "CHAPT 7AA.TXT", WHICH APPEARS TO BE JUST AN EXAMPLE OF A CREDITOR MATRIX.

: : Also ask:

: : 1. How many copies of your filing you should make?
: : ORIGINAL + 2

: : 2. Does the Court provide you with a floppy disk to fill out the creditors matrix, for the emergency petition?
: : NO, BUT YOU CAN USE THEIR COMPUTER TO ENTER DATA. LATER HOWEVER THEY GAVE ME A FLOOPY WITH JUST ONE TEXT FILE, APPARENTLY AN EXAMPLE OF THE FORMAT THEY WANT TO SEE FOR THE CREDITOR MATRIX.

: : 3. Can someone else actually file the emergency petition for you?
: : YES.

: : 4. What happens if you don't file the balance of the whole petition within the 15 days (after filing the initial emergency petition)?
: : DISMISSED, LOSE MONEY, START OVER.

: : 5. Can you pay less than the regular filing fee if you are destitute?
: : NO. $185 FEE. BUT YOU CAN PAY $92.50 THEN $92.50 IN 30 DAYS.

: : 6. In what form can the filing fee be paid? If you pay it in cash you MUST have the exact amount, for they will not make change!!
: : CASH OR CERTIFIED FUNDS.

: =??????????

: Greg,

: “Gump, you’re a genius!?
: I have to tell you that I’m impressed. You now know how to stop a foreclosure in its tracks, at any point up to a minute before the foreclosure sale!!

: So at this juncture, make copies of the forms the Court’s clerk gave you and copy the format of the floppy disc onto several others—one for each postponement kit you’re making.

: When you get this far I’ll take you to lunch. I want to pat you on the back!
