tile insurance

Posted by gcastro on December 18, 2003 at 1:40 PM

I found a buyer for a property and we are ready to close. The title insurance comany (Fidelity National)that provided the prelim was willing to insure it, but now they say that they won't insure it becouse there is a judgment recorded against the previous owner. I argued that the judgment was recorded after my deed was recorded, and that I had no knowledge of it, but the Title company said that they don't want to take the risk because even thought the judgement was recorded after my deed was recorded, the issue date for the judgment was issued by the judge before my deed was recorded, and that it is too much risk for them, specially becouse I didnt buy with the benefit of title insurance. Any imputs? Should I try a diferent title company?
