Yes a bankruptcy filing will stop an eviction dead in its tracks...In Reply to: Eviction & Bankruptcy posted by Jim - Florida on December 12, 2003 at 10:36 PM : Ward, : If a tenant declares bankruptcy during an eviction will that stop the eviction process? : Thanks Jim, Yes, the filing of a federal bankruptcy petition automatically stops a creditor's legal action against the petitioner until the creditor convinces the bankruptcy court to grant them relief from the automatic stay of the bankruptcy filing.
