Try to work out a reinstatement plan with your lender..

: Hello, : I've been looking every where for help. I sincerely hope you can help me with the information I need. My home was foreclosed on and I filed chapter 7 bankruptcy. My bankruptcy has since been discharged. The mortgage holder is still trying to take the home. My partner also filed bankruptcy but his was a chapter 13. He defaulted and the bankruptcy was dismissed. He then re-filed. Right now the mortgage holder has filed an objection to the bankruptcy. The refuse to accept any house payments despite the bankruptcy. They are determined to take our home. Is there any thing we can do? The builder of the home also carries the mortgage. The loan is for 10 years at 10% and the balance of the entire loan must be paid at the end of the 10 years. The trustee said he doesn't believe the loan was legal. I just need to know what to do to save our home. We don't have a lot of money to obtain a high priced attorney. We are due in court on the 18th of December. The mortgage holder says we are in arrears to the tune of 15,000 plus. This is not true. Wen I look at their records they have some payments listed twice in a month when it should have been for the following month. I previously sent copies of my receipts to the company and they then told me okay, you're only 2 months behind. On their records for the past 10 months they didn't calculate any amount going to the principal (only the interest). When I didn't pay a month I made the payment up the following month with 2 payments. The mortgage holder said that's not the way it works. Please tell me what I can do to save my home. : Thank you, : Sonya ===================== Sonya, At least you’re able to communicate with your lender. So ask your mortgage holder what they figure it will take to reinstate your delinquent loan at this time. If you can’t come up with total arreage all at once propose an installment plan you can deal with. Hope this helps.
