Lug,

I'd use the EPA because I'm not aware that California's legislators thought this through suffiently enought to EXCLUDE your scenario. TEchnically, this is an owner occupied residence and just becasuse lenders and property tax assessors see the land as separate from the structure is merely an issue of appurtenance (what attaches to the property).
Also, you know how things work: If you take the conservative approach you'll probably NEVER have a problem; if you try to cut corners you could have another story to put in Lughead's "Files from Hell" collection.
