As a beneficiary, I began foreclosure on somebody that eventually filed BK. I asked my attorney if I had to start the whole NOD thing over again if they stopped paying according the BK plan, her answer was once they start paying, you have to start the whole thing over again.

It would seem that if a beneficiary is required to restart foreclosure, the NOD is somehow inactive.

If the NOD doesn’t become inactive at this point, when does it become inactive?


Personally, if a recorded NOD doesn’t have a recession or reconveyance I would use the EPA.
