renting and property is in the process of forclosure

We have been renting for 9 months. We found out 4 months ago that the owner of the property is in the process of being forclosed. We contacted a real estate agent and immediatly began looking for a home. We have gotten some info from the agent reguarding the property, as we were trying to do a quick sale. Seems that the owner is behind at least 9 months or more.
We have decided to purchase another property as this was not a good buy, for he owes to much. My question is this. Since we feel he has broken the lease and ultimatly entered into the lease fraudulently, Do we owe him rent. We have not paid him for the last two months, as we needed to find a place to live and thus this cost money, ie) down payment, closing costs and prepaids. We feel he does not rightfully get this money as the property is going into forclosure and we would eventually be asked to leave. What are our rights and what is the right thing to do. This guy is a fraud he owes everyone and now is jobless and has been living off our money. HELP!!!!!!!!!
