Ward, what does it take for a trust to be valid and effective?

Troy, many different trust formats exist. So the first thing to do is make sure you have the applicable Declaration of Trust and then see to it that:

#1. The declaration is properly filled out, signed and dated by the trustor and trustee.
#2. The trustor of the trust has transferred some asset(s) into the trust. If the asset is real property, then the property should be transferred into the trust via a recorded deed.
#3. For privacy reasons, trust declarations themselves are rarely, if ever recorded
