Finding an older judgment

: Ward,

: I know judgments are good for 10 years in Ca. and may be renewed every 10 years, is this based on the recording date, or the date that a judgment was awarded.
: If based on the recording date, do unrecorded judgments expire after a certain period of time? The reason I ask is that I have a judgment worth about $56K against a indvidual that lives in Utah, I have not obtained a sister state judgement, and have not tried to collect on this for aproximately 5 years now.
: Lastly are these judgments public record if not recorded? If so where shall I go to obtain a copy of the judgment ( I dont even have a copy of the judgment or know the individual's name anymore, this was written off as bad debt along time ago but maybe there is still hope to collect it. )

: Thanks,

: Travis

=================

Travis,

A judgment's timetable begins with the entry of judgment in the Court's record?not the date it was recorded in the county recorder's records.

As far as the length of time that's accorded a judgment in Utah, it might be more or less than the time accorded a judgment in CA. Also some states don't permit the renewal of judgments. So check both of these items with what's allowed in Utah.

To find an non-recorded judgment go to the Court that heard the case and issued the judgment. Visit the Clerk of the Court's office and look in the civil, plaintiff/defendant index under either name to get the case file number.

With the case file number request the case file from the counter clerk. You will be able to peruse the case file in the court clerk's office to your heart's content. Put a paper clip on any page you want a copy of and the clerk will accommodate you.

Hope this helps.
