Foreclosure/eviction when legal owner has died.

Posted by Chris on October 07, 2003 at 9:59 PM

I've recently purchased a foreclosed home from the courthouse steps of Kansas City, Missouri. The issue I'm now faced with is the original owner of the house died 3 years ago. Since this time, her boy friend and son have been occupying the property. A letter of eviction was provided to the son, which he agreed to leave within 10 days as requested. The boy friend however is refusing. For three years he has lived at this house making no payments since the owner died. His name is not on any of the utilities and there is a concern now based on others who know him, that he might vandalize the property out of spite. This was not an investment property. This is a home I purchased for myself and 2 kids. I have 30 days before I have to be out of my current residence. What can I do to have him removed? Since I've provided him with a letter to vacate, can I now use the help of the local police department or do I have to fight this out in court? My concern is the time it will take to run through the court system. Since his name was not on the loan, nor did he have a leasing agreement, what rights does he have?
