Possible NOD Probate??

Hi everyone.

I'd been sending letters to an owner in default who I just recently found out is deceased. The owner's heir (daughter) was the caretaker and is planning on letting the home go back to the bank. She is very interested however in letting me takeover the payments or buy the home outright. I'm not sure if she's the sole heir however. I'll speak with her today about that as well as find out the exact terms on the existing loan. I'm not sure how to work this angle however since she's not even the owner.

Because the owner is now deceased, it puts a cloud on title. I can't buy it from the owner outright. I'd like to either work a short sale or take title subject to. How do I get around this?
