two owners, one abandoned owner.

Hello Ward,
I have a situation where theirs two owners to a property that they purchased in 92. Six months later one of the owners abandoned the property without any quitclaim transfer to the remaining owner. Since the remaining owner has maintained and kept up with the mortgage payments on the property from time of purchase till the present and is now interested in selling the property.

1.Does the owner have to take legal action in the form of a partition order in order to sell the property?

2. The owner that abandoned the property refused to sign a quitclaim deed. Is their any other alternatives to this situation in order to have the property sold or title completely transfered out the the abandoned owners name?
