: We were going to buy this property in California from this guy. Come to find out he had 'purchased' the property from this lady in May of 2000, and has yet to make a payment to her. She doesn't know what to do. Can she foreclose on him on her own, or is an attorney recommended and does this involve going through the court system.

Bill, hopefully the lady carried back a promissory note for the money owed her, secured by a recorded deed of trust. If so all she has to do, with no out-of-pocket expense, is to start a foreclosure with a professional trustee (I can recommend some if you wish). Here in CA we don’t need lawyers or any court procedure since the foreclosure process is all non-judicial.

Hope this helps.
