A junior lien can foreclosure without regard of a senior lienIn Reply to: I am the Junior Lien posted by Enrique on September 26, 2003 at 8:10 AM
: If I finance someone who owns a property, and that property is being used as collateral. I would be the second lien though. What happens if the owner defaults on her payments to me but not to the senior. How can I try an get my money back if the senior lien has first right. Enrique, Every lien, regardless of its priority, can independently initiate a foreclosure for the sole purpose to force collection on just its own indebtedness. Hope this helps.
