: Hi Ward,
: While researching a property that's going to sale 9/29/03
: I found an abstract of judgment for over a half a million
: dollars from 1997 and a voluntary petition (BK) filed aprox
: 4 months prior to the abstract. My question is, would the BK
: render the abstract of judgment null and void.
: I've noticed that the home owner has generated 6 (six) TD's since the abstract was filed.
: How can I check the status of the abstract.

: Thanks,
: Abe

Abe,

Check on the bankruptcy via PACER back in 1997 and see what their docket of forms discloses. My initial feeling is that the Abstract of Judgment (AJ) occurred subsequent to the bankruptcy...so it wasn’t wiped out by the earlier bankruptcy action.

Also, look in the court case that generated the AJ and see what’s been entered, if anything, concerning a Satisfaction of Judgment.

Hope this helps.
