Bankruptcy filing temporarily stops a foreclosure.In Reply to: Chapter 13 bankruptcy and foreclosure posted by Nick on September 09, 2003 at 7:34 AM
: If you file a chapter 13 bankruptcy just before the foreclosure sale does it temporarily stop the sale or permanently stop it? Also, do you still owe the whole summary judgement amount, or continue making monthly mortgage payments? The state is Florida, and how many months before the bankruptcy is dismissed? -=-=-=-=-=-=-=-=-=- Nick, the filing of a bankruptcy (generally Chapter 13) results in a temporary stop (generally 30 days) in the progress of the foreclosure. Then the foreclosure resumes forward and won't stop, until the payment default is successfully reinstated by the homeowner or a junior beneficiary, or until the foreclosure auction takes place.
