Affidavit of Deed

Zachary,

No, the EPA (equity purchase agreement) is not enough to act like an estoppel. So there exists a form, one that requires a notarized signature, called the Affidavit of Deed that was created by the title industry for that purpose.

Just make sure the affidavit is executed in front of a different notary public than the one used to notarize the grant deed to you from the seller-in-default. Also make sure that there are a few days or more between executing the deed and the signing of the Affidavit of Deed.
