Speak softly but carry a big stick...In Reply to: need to do eviction posted by gcastro on September 02, 2003 at 8:07 PM : I served my tenants with a 60 day notice about 45 days ago, and have talked to the tenants, but is seems that they haven't really made plans to move yet. (they are not taking it seriously)What should I do? Wait until I find out that they are not moving? Or contact an attorney to file for an eviction tomorrow? How long does the process usually take? =-=-=-=-=-=-=- Gus, First, I would sometime during the next 15 days explain to your tenants the negative effect an eviction lawsuit is going to have on their future credit record if you're forced to resort to an unlawful detainer (UD) to dislodge them. Explain that the UD will also attach to the credit records of their adult children who might still be living at home with them (since all 18 year olds and older have to be named in the UD lawsuit). Then I’d wait. You’ve only got another 15 days to go before your 60 day notice has run its course
