Re: Reinstating a lien during a CA foreclosureIn Reply to: Reinstating the 1st... posted by Alfred CA on October 09, 2001 at 11:42 PM
: Ward, : Also, as second question... the TTEE sale is scheduled for 11:00 am on Oct 15th and we were told that the reinstatement amount we were quoted was only good until the 12th. I just realized that the statutory law says that one can only reinstate up until 5 days prior to the TTEE sale. In this case Oct 8th would be the last day to be able to reinstate. So what is the deal, the TTEE and bene are just not enforcing it? ============= Alfred, as far as your first question is concerned, you have a couple of examples of such a letter in the Repossession/Mgmt. section of your Resource Manual. And as far as your second question is concerned, the trustee has the discretion of insisting on the full amount due or just the reinstatement amount within the five business days prior to the scheduled trustees sale.
