No problemIn Reply to: Conveyance to a party not on deed of trust. posted by Kennyboy on August 15, 2003 at 6:35 AM : Greetings: : I am researching a foreclosure on a second where the trustor made a deed of trust to the bank and subsequently granted joint tenancy to his wife. The notice of trustee sale by the second only lists the husband as trustor. : Is this a problem? If I buy it will they only convey title from him and not her? Does she have a claim to title if I buy at the sale? : What recourse does the bank have to clear this up if they can only covey title in his name and not hers? : Thanks, : Ken =-=-=-=-=-=-=-=-=-=-=-=-=-=-=- Ken, Subsequent changes to the title of property will not affect the seniority of prior liens. So, no this is NOT a problem and you will get ALL the title if you buy at the foreclosure auction. Follow Ups:
