: Ward, does a notice of pending action that was recorded after the deed of trust that is foreclosing get extinguish at the trustee sale? Gonzalo, Yes, if the lis pendens concerned a contest as to who owned the property. That’s because the trustee’s sale will wipe out all claims to title and make the winning foreclosure bidder the new property owner.
