Your determination of value is key..In Reply to: Question regarding Personal vs Real Property posted by Lughead on July 11, 2003 at 7:47 PM : hello : is a dough-boy above ground pool left behind considered personal property?? - ie do we need to store it and then 'auction' it off ?? : thank you If the pool is not permanently attached to the property, then it is considered personal property and not included with the real property acquired at the trustee's sale. If such personal property is worth less than $300.00, in YOUR personal opinion, then after the notice period elapses you may do with it as you wish. If it's worth more than $300.00 then you have to deal with the requirements of an arm's length sale.
