: Ward, what about the similarities between these states when it comes to equity purchases from the trustor? Are there equivalents to CC 1695 and the like in AZ? I've tried to find any myself in the AZ code, but I keep coming up emptyhanded. Any info or perhaps even specific code numbers would be awesome.

Daniel,

No, Arizona doesn’t have any draconian codes similar to our CC 1695 governing matters such as “unconscionable advantage” issues, cooling off periods, specific contract language, etc.

Yes, just as a matter of fair dealing , taking “uconscionable advantage” of a homeowner could be a justiceable issue almost anywhere, it’s just not codified in a particular statute, in regards to foreclosure, like it is in CA.
