What you missed...In Reply to: Ward - why 60 days?? posted by Lughead on July 03, 2003 at 8:50 PM : ward : why would a 60 day notice be required - they are Holdover tenants - : seems that would be a 30 day notice ....due to foreclosure : i don't believe the 60 day notice applies to Holdover tenants - - can you let us know if something has changed or if we are missing something : thank you -=-=-=-=-=-=-=-=-=-=--=-=- Lunk, What you missed is that Gonzalo bought the foreclosure property pre-sale. So the occupants aren’t post-sale holdover tenants and thus not subject to the post-sale vacate rules. So now you know “why the 60 days”. But if you’re not convinced, just read up on the new (began this year) 60 day notice requirement that CA now requires an owner give a tenant in the instance of a “no cause” notice to quit.
