John owns the entirety...In Reply to: Quitclaim deed and community property posted by Travis-CA on July 01, 2003 at 5:12 PM : Lets assume that John and Jane a married couple own a home and title is held as tenants in common. If Jane gives John a quitclaim deed today and they remain married, because of community property laws would Jane still have a interest in the property a month down the road? From what I understand a quitclaim deed only transferes interest up until the point of delivery. So if last month Jane delivered a quitclaim deed and this month I sign a EPA with John will I also need Jane to sign? : : Travis Travis, No, once Jane disavowed any interest whatsoever in the property and deeded whatever her interest was to John, she gave up any and all present and future community property claims against the property.
