Not a problem..In Reply to: selling out of a land trust.... posted by zachary on July 03, 2003 at 9:56 AM : Ward, : : My questions: : 1. Do they make offers to "trustee, of xxxx trust"? : : Zachary -=-=-=-=-=- Zachary, No, we don’t have any problems with buyers’ agents when selling out of a trust. I suppose a buyer’s agent doesn’t really care who the owner is as long as marketable title is transferred to their client. They know that escrow will deal with the issue and that it’s not the agent’s worry. #1. Offers aren’t generally made directly to a named seller. Look at your standard offer paperwork and you’ll see what I mean. The seller signs an acceptance of offer and in that spot the trustee would sign something like, “Eric Hanigan, Trustee”. #2. Nope, have never had anyone ever freak out because title to property was in a trust. #3. A buyer’s agent is generally concerned with disclosure issues, termite clearances, etc.
