: Ward,

:
: When selling a property that you took title via a land trust do you ever run into problems dealing with the buyers agents?

: My questions:

: 1. Do they make offers to "trustee, of xxxx trust"?
: 2. Do they ever freak out about the property being in a trust?
: 3. Are there any issue that have come up when dealing wiht the buyers agent?

Zachary,

No, we don’t have any problems with buyers’ agents when selling out of a trust. I suppose a buyer’s agent doesn’t really care who the owner is as long as marketable title is transferred to their client. They know that escrow will deal with the issue and that it’s not the agent’s worry.

#1. Offers aren’t generally made directly to a named seller. Look at your standard offer paperwork and you’ll see what I mean. The seller signs an acceptance of offer and in that spot the trustee would sign something like, “Eric Hanigan, Trustee”.

#2. Nope, have never had anyone ever freak out because title to property was in a trust.

#3. A buyer’s agent is generally concerned with disclosure issues, termite clearances, etc.

Hope this helps.
